"WHEREAS, on 03 November 2009, Global Terminals & Development, Inc. (GTI), pursuant to The Supplement and Amendment to the Lease Agreement between SBMA and GTI which was approved by this Board on 03 April 2009, filed an application for initial rates of road user's fees, as follows:

EXEMPTIONS:
1. Vehicles of SRF Locators (subject to procurement of SRF stickers to be issued and regulated by GTI) their employees and guests.

WHEREAS, on 13 November 2009, GTI filed an application for initial rates of pier side cleaning fee, as follows:

WHEREAS, the application for initial rates of road user's fee; application for initial rates of pier side cleaning fee and the 28 December 2009 SBMA Notice of Public Hearing were duly posted at least 15 days before the public hearing on 19 January 2010 at 2:30 P.M. at the SBECC and all entities of interest were served copies of the same notices and applications before the date of the hearing;
WHEREAS, the Committee created under The Supplement and Amendment to the Lease Agreement and SBMA Office Order No. 09-09-1336, after the public hearing and due consideration of the applications as well as the views of entities of interest at the public hearing, issued a Resolution, approving the applications with the following modifications:

WHEREFORE, RESOLVE, as it is hereby RESOLVED that the Committee Resolution dated 16 February 2010 approving with modifications the applications of GTI dated 03 November 2009 and 13 November 2009, for initial rates of road user's fee, and initial rates of pier side cleaning fee, above quoted, is hereby approved and ratified.
